Terms of Service — The Mindfulness Game
Last updated: 21 October 2026
1. Provider and scope
The Mindfulness Game (the “App”) is provided by Tjingmackan AB, Swedish organisation number 559483-3815, Sehlstedtsgatan 3c, 115 28 Stockholm, Sweden (“we”, “us”). Questions, support requests and complaints can be sent to support@mindfulnessgame.com.
These terms explain our App offering, pricing and responsibilities. They apply where made available to you and validly incorporated into your purchase or use under applicable law. They do not retrospectively impose new conditions on an earlier purchase.
For App Store downloads, Apple's Standard End User License Agreement governs the software licence. These terms supplement that licence and do not replace it or modify Apple's separate agreement with you. Apple's applicable usage rules continue to apply. If these terms conflict with the applicable Apple licence or purchase terms, those terms govern the relevant licence or App Store transaction. Mandatory law always takes priority.
2. What you are purchasing
The App is a quiet, interactive space experience for compatible Apple Watch devices, with an animated astronaut, music and short space facts. It is intentionally open-ended: there are no scores, levels, streaks, competitive objectives or guaranteed number of hours of play. The experience and features described in the App Store listing at purchase form part of what you are entitled to receive.
The App is for entertainment and general relaxation. It is not medical treatment, a diagnostic service or a substitute for professional care. We do not promise a particular improvement in sleep, stress, concentration or health. Space scenes are artistic representations; short facts are general educational content rather than a complete scientific reference.
Check the App Store listing for device compatibility, operating-system requirements, language availability and features before purchase. The current App requires a compatible Apple Watch running watchOS 26 or later. Its core experience works offline after installation; downloading, updating and some Apple services require an internet connection. Device and connectivity costs are separate from the App price.
3. Price and payment
The standard US App Store price is US$1.99 as a one-time purchase. There is no subscription, recurring App fee or in-app purchase in the current App.
Prices in other storefronts may differ because of local currency, taxes, exchange-rate adjustments or regional pricing. The final amount and currency shown by the App Store before you confirm the purchase are the amount you agree to pay, including any applicable taxes shown at checkout. The US$1.99 reference is not a promise that every country will charge the same numerical amount or currency equivalent.
The payment buys the right to use the App under the applicable licence. It is not a payment per minute, per session, per achievement or per feature used. You may use the App briefly, frequently or rarely without changing the agreed purchase price.
We may change the price for future purchases or offer promotions. A later discount, free promotion, exchange-rate movement or price change does not, by itself, create a right to a refund or price adjustment for an earlier purchase. We offer no additional price-match guarantee. This does not limit a statutory remedy, an express promise made at purchase or rights under Apple's applicable policies.
We will not impose a subscription or additional charge for the App you purchased without a separate purchase or express agreement. A one-time purchase does not promise every future separate product or optional expansion, but it includes the content and functionality promised at purchase and all updates and remedies required by law.
4. Refunds, withdrawal and faults
For an App Store billing or refund request, use Apple's Report a Problem service. You can also contact us about a defect or complaint. Using Apple's process is not a condition that removes claims you may have against us under applicable law.
We do not offer a separate voluntary money-back or satisfaction guarantee. Where permitted by law and subject to Apple's applicable refund policies, personal preference, limited use or a later price reduction alone does not entitle you to reimbursement. This is not a blanket “no refunds” policy.
If a statutory withdrawal period applies, you retain it unless the legal requirements for its loss are met. For EU/EEA digital content supplied immediately, this generally requires your prior express consent to supply during the withdrawal period, your acknowledgement that this means losing the withdrawal right, and the required contract confirmation. Merely reading these terms, opening the App or accepting general terms is not a substitute for those requirements.
If the App is faulty, not supplied or does not conform to the contract, you retain applicable remedies, which may include bringing it into conformity, a proportionate price reduction, termination or reimbursement. No clause here shortens a mandatory complaint period, excludes required updates or removes remedies for misleading descriptions or unauthorised charges.
5. Licence and acceptable use
The App and its artwork, animation, music and other content remain protected by intellectual-property rights. Your purchase does not transfer ownership of those rights. Your use, permitted copies and any Family Sharing access are governed by the applicable Apple licence and usage rules. Any separately licensed component remains subject to its own licence notices.
Do not redistribute the App or extract and commercially reuse its assets without permission. Do not circumvent protections or interfere with the App's lawful operation. These restrictions do not prevent activities permitted by mandatory law or an applicable component licence.
Purchases must be made by someone legally able to authorise them, with parent or guardian involvement where required. Nothing here makes a child responsible for a purchase that is not legally binding on them.
6. Support, updates and availability
Contact support@mindfulnessgame.com for support. Include the App version, Watch model, watchOS version and a description of the problem where relevant. Do not send passwords or full payment-card details.
We will provide conformity and security updates to the extent and for the period required by applicable law. Install necessary updates made available to you; any legal consequences of not installing an update depend on the applicable law and the information and instructions provided with it.
We may release improvements and corrections. We do not promise unlimited new features, compatibility with every future device or operating system, or perpetual availability for new downloads. However, these statements do not permit us to remove paid-for functionality, materially reduce what you purchased or discontinue legally required support without complying with applicable law and any required notice or remedy.
7. Privacy
Our Privacy Policy explains the App's local processing, support correspondence and Apple-provided reports. Acceptance of these terms is not consent to unrelated tracking or marketing.
8. Responsibility and limits
We remain responsible for supplying the App as agreed and for our obligations under applicable law. We do not guarantee uninterrupted or completely error-free operation beyond the standards the law requires.
To the extent permitted by applicable law, we are not responsible for losses caused solely by your use contrary to these terms, unsupported device modifications or events outside our reasonable control where we could not reasonably prevent their consequences. We do not exclude responsibility for our own failure to meet a legal duty merely because a third party is involved.
For consumer purchases, nothing in these terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited. Your mandatory rights concerning digital content, compensation, privacy and unfair contract terms remain intact. The low purchase price does not itself limit those rights.
9. Changes and ending use
You may stop using and uninstall the App at any time. Uninstalling does not itself request or create a refund. Licence termination is governed by the applicable Apple licence and mandatory law.
The terms applicable to your purchase remain applicable to that purchase. We may revise terms for future transactions, showing the new date and making them available before purchase. Any change affecting an existing contract requires a lawful basis, appropriate notice and any consent or remedy required by law. A website update alone does not reduce rights attached to an existing purchase.
10. Swedish law and Stockholm courts
These supplementary terms and disputes with Tjingmackan AB under them are governed by Swedish law. If you are a consumer, this choice does not deprive you of mandatory protections under the law that would otherwise apply, including the law of your country of habitual residence where applicable.
To the extent a venue agreement is legally permitted, disputes under these terms shall be brought before the courts of Stockholm, Sweden, with Stockholms tingsrätt (Stockholm District Court) as the court of first instance. This clause does not require a consumer to give up a right to bring proceedings in another competent court, including a court where they live, or allow us to sue a consumer elsewhere when mandatory rules prohibit it. It does not alter the governing-law or venue provisions of Apple's separate agreements.
You may contact us to seek an informal resolution, but doing so is not a prerequisite to exercising legal rights. You may also submit an eligible consumer dispute to Allmänna reklamationsnämnden (ARN), subject to its jurisdiction, value thresholds and other admissibility rules, or seek help from your local consumer authority. Nothing prevents a lawful complaint, honest review or report to a regulator.
11. Remaining provisions
If a provision is invalid or unenforceable, it will not bind you to that extent. The remaining terms continue only insofar as the contract can lawfully continue. Failure to enforce a provision on one occasion does not waive rights on another. These terms do not cancel binding statements made in the App Store listing or other pre-contract information required by law.
